EldersTalent.com is operated by Tharsha Ventures Private Limited (“EldersTalent”, “Company”, “We”, “Our”, or “Us”). Our Platform connects elderly individuals (“Elders”) with companies, non-governmental organizations, individuals, and other entities (“Third-Party Organizations”) seeking to engage them for:

  • Work Opportunities
  • Recreational Activities
  • Skill Development
  • Volunteer Work
  • Other Various Engagements (“Opportunities”)

Our goal is to provide Elders with a platform to showcase and utilize their talents. EldersTalent.com serves as an initial contact and information exchange medium, intended solely for genuine Opportunities offered by Third-Party Organizations to Elders.

 

The Terms of Use (“Terms”) outline the terms and conditions under which we provide access to our Platform and Services.

For the purposes of these Terms:

a. Third-Party Organizations and Elders are individually referred to as a “User” and collectively as “Users”.

b. EldersTalent and Users are individually referred to as a “Party” and collectively as the “Parties”.

 

These Terms constitute an electronic record under the Information Technology Act, 2000 (“IT Act”) and its applicable rules, including amendments related to electronic records. This electronic record is created by a computer system and does not require physical or digital signatures. It is published in accordance with Rule 4 of the Information Technology (Reasonable Security Practices and Sensitive Personal Data or Information) Rules, 2011.

 

Consent to Terms

 

EldersTalent encourages Users to read and understand these Terms thoroughly to understand how we will provide our Services. By:

(i) Installing or otherwise accessing our Platform;

(ii) Availing the Services; or

(iii) Using any other services,

You consent to be bound by and abide by these Terms.

If you do not agree to these Terms and our Privacy Policy available at [link], please do not install the app or access the website. You are required to review and understand these Terms, our Privacy Policy, and any other rules and regulations imposed by applicable law before providing your consent.

 

1. User Eligibility

 

1.1. Users of the Platform or Services may include natural persons, legal persons such as Non-Governmental Organizations (NGOs), companies, or any other entities acting as non-profit organizations, as well as other natural or artificial legal persons wishing to access our Platform’s Services. Users must have the full capacity to avail of the Services and access the Platform, and must be able to assume legal responsibilities independently.

1.2. By using our Platform or Services, you represent and warrant that you are at least eighteen (18) years of age and are fully capable and competent to understand and agree to the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.

 

2. User Registration

 

2.1. To access most aspects of the Services, you must register for and maintain a User account (“Account”).

2.2. To register on the Platform, open the “Register” tab and complete the registration form (“Registration”). During Registration, you will need to provide your name, email address, and create a password (“User Information”) for your Account. We will confirm your Registration by sending a confirmation email to your registered email address. You are responsible for maintaining the security of your account, password, and files.

2.3. Upon completing Registration, you will become a registered User of the Platform and eligible to subscribe to our Services.

2.4. User Information provided during Registration must be accurate, correct, and complete, and should be kept up-to-date. The handling of your User Information is governed by our Privacy Policy.

2.5. Registration may be denied if the information provided is found to be inaccurate or if the location provided does not fall within the borders of India.

2.6. Important information related to your Account, including security and privacy notices, will be sent to the contact information you provide. You can review and update some of the information you have provided via the Platform.

 

3. Scope of Our Services

 

Under our Services, EldersTalent offers a platform for Elders to connect with Third-Party Organizations for various opportunities. The scope includes:

3.1. Voluntary Engagement
Elders interested in giving back to society may connect with Third-Party Organizations for roles such as volunteering, pro-bono teaching, advisory board positions, and assignments within NGOs.

3.2. Learning Engagement
Elders looking to learn new skills—such as technology, art, music, or languages—can connect with Third-Party Organizations for services that require these skills.

3.3. Professional Engagement
Elders seeking full-time or part-time professional assignments, including online roles or board memberships, can connect with Third-Party Organizations offering such services.

3.4. Entertainment and Recreation Services

Elders can engage with Third-Party Organizations for offline recreation and entertainment services, such as games, social gatherings, and events, as well as online entertainment games like antakshari and Tambola.

 

4. Procedure for Availing Our Services

4.1. Listing Opportunities
Upon completion of User Registration by Third-Party Organizations, we will list details relating to available Opportunities on the Platform. Each Third-Party Organization is entitled to a number of listings as agreed upon during the subscription period.

4.2. Availability and Display
All information provided by Third-Party Organizations will be accessible to Elders registered on the Platform. We may, at our sole discretion, include the Opportunity provided by a Third-Party Organization for display on our Platform. We are not liable for the usage or publicity of such information. Opportunities will be listed for a fixed period (currently 30 days), which may change without prior notice.

4.3. Contact Information
Third-Party Organizations may provide up to two email addresses for collecting responses to the listed Opportunities.

4.4. Elder Profiles
Each Elder subscribing to the Services will have a User profile (“Profile”) on the Platform. Elders must keep their Profile updated with relevant information for the engagements they wish to pursue. Those applying for Professional Engagements must upload their Curriculum Vitae (“CV”) to their Profile. Access to an Elder’s Profile is limited to us, our representatives, employees, consultants, and affiliates, and will not be publicly available. Elders can update their Profile details free of cost at any time. Profiles will be included in our proprietary database, accessible only by us.

4.5. Searching and Applying for Opportunities
To search for Opportunities and apply, Elders must log into their accounts on the Platform. They can search for Opportunities that meet their needs and contact us through the Platform to apply. We will then connect the Elder to the relevant Third-Party Organization regarding the Opportunity they wish to pursue.

4.6. Message Limits
Elders can send a message of up to 500 characters, along with a subject line of up to 500 characters, for any enquiry or application related to an Opportunity. Similarly, when Third-Party Organizations list Opportunities, we will connect them with Elders whose Profiles match the requirements. We will curate Elder Profiles to align with available Opportunities.

4.7. Final Decision
Our decision regarding all transactions under this Service is final and binding. We will not entertain any correspondence regarding these decisions.

4.8. Modification of Opportunity Details
We reserve the right to modify or edit Opportunity details to fit our database as needed.

4.9. Platform Changes
We reserve the right to change the look, feel, design, prominence, and classification of any section of our Platform at any time, without providing reasons or prior notice.

 

5. Fees

The Services are currently available free of charge. However, we reserve the right to impose fees at any time, at our discretion, with prior notice to the Users.

 

6. Use of the Platform and/or Services

6.1. Permitted Use
Subject to these Terms, Users may use the Platform and Services as follows: (a) Register to become a Registered User. (b) Access details about the Services. (c) Avail themselves of the Services.

6.2. Prohibited Use
Users must not: (a) Use the Platform or Services in a manner that could damage, disable, overburden, or impair them. (b) Upload or transmit illegal or objectionable content. (c) Engage in transactions prohibited by applicable laws, including exchange control laws. (d) Make the Platform or Services available to unauthorized individuals. (e) Sell, resell, rent, or lease the Services without explicit written permission. (f) Use the Platform or Services to store or transmit malicious code. (g) Create derivative works based on the Platform or Services without explicit authorization. (h) Tamper with the security of the Platform or Services or with their Subscription/Registration. (i) Access data on the Platform or Services not intended for the User. (j) Reverse engineer the Platform or Services to: (i) Build a competitive product or service, or (ii) Copy features, functions, or graphics of the Platform or Services. (k) Post or transmit content that is abusive, obscene, sexually oriented, or against national interests. We reserve the right to suspend profiles and initiate legal proceedings for any prohibitive or objectionable content. (l) Use the Services for unlawful purposes or in violation of these Terms. (m) Use false email addresses, impersonate others, or mislead us with multiple addresses or phone numbers. (n) Use “deep-link”, “page scrape”, “robot”, “spider”, or similar methods to access or monitor any portion of the Platform. We reserve the right to block such activities and ensure compliance with applicable laws, including the IT Act. (o) Attempt unauthorized access to any portion or feature of the Platform, or to systems or networks connected to the Platform, through hacking, password mining, or other illegitimate means.

6.3. Obligations of Elders
In addition to the above: (a) Elders must provide genuine and accurate details on the Platform. CVs or resumes for Professional Engagements must contain true and verifiable information. Misrepresentation may lead to termination of access and legal consequences. (b) Elders are solely responsible for all content, information, and data transmitted via the Services and must indemnify us against third-party claims related to such content or their actions. (c) Elders are responsible for the security of their account credentials. We are not liable for data loss, theft, corruption, or misuse of passwords. We will take reasonable precautions to protect account security.

6.4. Obligations of Third-Party Organizations
In addition to the above: (a) Third-Party Organizations must ensure that Opportunities advertised are genuine and that they have authority to do so. (b) No fees should be charged to Elders responding to Opportunities for processing their applications. (c) Third-Party Organizations must comply with our directions and provide any additional information and cooperation as required. (d) They must obtain necessary licenses/permits for providing Opportunities and indemnify us against related claims. (e) They must provide necessary support to Elders regarding Opportunities. (f) Timely payments to Elders, if applicable, must be ensured. (g) Compliance with applicable data protection laws is required, ensuring that personal data is processed lawfully and is not excessive. (h) Adequate technical and organizational controls must be implemented to protect personal data against unauthorized processing and accidental loss or damage. (i) Responsibility for misuse of personal details lies with the Third-Party Organizations. Access to Services should be restricted to authorized personnel only. (j) Reasonable assistance must be provided for handling any data security breaches in compliance with privacy laws. (k) Personal data obtained from us must not be disclosed or transferred to sub-processors without equivalent safeguards. (l) Personal data should not be retained or processed longer than necessary for the agreed purposes. (m) Third-Party Organizations act as independent data fiduciaries for the personal data obtained and are responsible for its secure use. (n) Control over accounts and devices used to access the Platform must be maintained to prevent unauthorized access. Passwords and confidential details should not be disclosed. (o) If suspicious activity is noted, we may impose restrictions on or disable access to the Third-Party Organization’s account.

 

7. Termination

7.1. Effectiveness of Terms
These Terms remain in effect unless terminated by either the User or us.

7.2. Suspension and Termination by the Company
We may suspend or terminate access to a User’s Account and Services if: (a) There is unauthorized access to the User’s Account. (b) There is a violation of these Terms. (c) The User’s use of the Platform and/or Services violates applicable laws or regulations. (d) The User’s use of the Platform and/or Services poses a risk to the Platform or other Users.

7.3. Continued Suspension
If the reason for the suspension persists for 15 (fifteen) days, we may, at our sole discretion, terminate the User’s access to the Platform and/or Services, without prejudice to other remedies available under these Terms or applicable laws.

7.4. User-Initiated Termination
You may terminate these Terms at any time by canceling Your Account on the Platform and discontinuing Your access to and use of the Platform.

7.5. Account Deactivation
Accounts will be deactivated if Users completely and permanently cease to use the Services for a continuous period of 12 (twelve) months. Accounts may be reactivated upon request.

7.6. Data Removal and Retention
Upon termination, we will take reasonable steps to remove or anonymize Your personal data from our systems, in accordance with our Privacy Policy. However, certain data may be retained as required by applicable law.

7.7. Outstanding Obligations
Termination does not absolve You of any outstanding obligations or liabilities incurred before cancellation. Any amounts owed to us for services rendered or transactions initiated before cancellation remain due and payable.

7.8. Cancellation Charges
We reserve the right to apply cancellation charges upon the cancellation of our Services, with prior notice to Users.

 

8. Modifications to the Service by EldersTalent

We reserve the right to modify or discontinue any Service (or any part or content thereof) at any time, with or without notice. We shall not be liable to Users or any third party for any modifications, suspensions, or discontinuances of the Service.

 

9. Errors, Inaccuracies, and Omissions

Occasionally, our Platform or Services may contain typographical errors, inaccuracies, or omissions related to service descriptions, pricing, promotions, offers, timings, or slot availability. We reserve the right to correct any errors, inaccuracies, or omissions and to update or change information without prior notice. We undertake no obligation to update, amend, or clarify information in the Service, including pricing information, except as required by law.

 

10. Non-Exclusivity

Any subscription agreement with us does not confer exclusivity of Service to any Elder.

 

11. Disclaimers

11.1. General Disclaimers
The Platform and Services provide Users with an electronic web-based platform that can be used in accordance with these Terms. However, the Company does not guarantee, represent, or warrant:

(a) That your use of our Service will be uninterrupted, timely, secure, or error-free.
(b) That the results obtained from using the Service will be accurate or reliable.
(c) Uninterrupted Service for indefinite periods of time or that the Service will not be canceled at any time, without notice to you.
(d) Conformity with conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
(e) The quality of Service obtained through the use of the Services.
(f) Any disclosure of information concerning the User’s Account and/or particulars or for any errors and/or omissions and/or inaccuracies regarding such information. We are not liable for any loss or damages resulting from such disclosure, whether intentional or inadvertent.
(g) That any Service is done at the User’s own discretion and risk, and the User shall be solely responsible for any damages, costs, or other consequences resulting from any transaction.
(h) That the Platform or its Users are liable for any damage suffered by any person as a result of any User’s conduct.

11.2. No Guarantee of Response
We neither guarantee nor warrant that there will be a satisfactory response or any response at all from Third-Party Organizations once a message is sent.

11.3. No Guarantee of Selection
Subscribing to or using various paid or free services on the Platform does not guarantee the selection for an Opportunity.

11.4. Opportunity Information
We make no representations about the suitability, reliability, availability, timeliness, or accuracy of the Opportunities on the Platform. All Opportunities are provided “as is” without any warranty. We disclaim all warranties and conditions regarding the Opportunities and are not responsible or liable for any consequential damages arising from them.

11.5. Responsibility for Verification
We are not liable for any information received by Elders regarding Opportunities. It is the sole responsibility of the Elders to check, authenticate, and verify the information or responses received at their own cost and expense.

11.6. No Warranty for Third-Party Organizations
We make no representations or warranties concerning Third-Party Organizations.

11.7. Third-Party Practices
We are not responsible for the practices employed by Third-Party Organizations or their services. Our role is limited to connecting you with Third-Party Organizations under our Service, and further activities will be governed by the Third Party’s own rules, policies, and practices, not our Agreements.

11.8. User Responsibility
You agree that any act or omission resulting from your interpretation of content on the Platform is solely your responsibility. You agree to indemnify the Company against all claims arising from your actions resulting from viewing content on the Platform.

11.9. “As Is” Basis
The Platform, Services, and all materials provided are offered “as is,” with no warranties whatsoever.

11.10. Disclaimer of Warranties
EldersTalent and its licensors disclaim all warranties, including those of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. They also disclaim warranties regarding the security, reliability, timeliness, and performance of the Platform and Services. This includes any services or advertisements on the Platform and any information or advice obtained through links provided by the Platform.

11.11. User Risk
You understand and agree that your use of the Platform and Services is at your own discretion and risk. You will be solely responsible for any damages to your computer system or loss of data resulting from downloading any material or data.

11.12. Jurisdictional Variations
Some states or jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. You may have other rights that vary from state to state or jurisdiction to jurisdiction.

 

12. Force Majeure

We shall not be held liable for any loss of data, technical issues, or information supplied by Users due to causes beyond our control. This includes, but is not limited to, data corruption, delays, or failures in performance resulting from circumstances such as:

  • Strikes
  • Riots
  • Civil unrest
  • Government policies
  • Tampering of data by unauthorized individuals (e.g., hackers)
  • War
  • Natural calamities

These events are beyond our reasonable control and may impact our ability to perform or provide Services.

 

13. Contents Posted on the Platform

13.1 Grant of Rights
The User grants EldersTalent a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, and sub-licensable (through multiple tiers) right to exercise all rights, including copyright, publicity, and database rights, in their User Information. This grant applies to any media now known or hereafter devised. EldersTalent may use the User Information for any purpose, including promotional and advertising purposes, without violating the User’s rights. This includes the creation of derivative works that may feature the User. Personally identifiable information will be handled in accordance with our Privacy Policy. The User agrees that any content posted may be used by EldersTalent in line with our Privacy Policy and these Terms, and acknowledges that they are not entitled to any payment or other compensation for such use.

13.2 Monitoring and Review
EldersTalent reserves the right, but has no obligation, to monitor, store, or review the User Information posted on the Platform.

13.3 Content Removal
EldersTalent has the right to remove or edit any content that, in its sole discretion, violates or is alleged to violate any applicable law or the spirit or letter of these Terms.

13.4 User Responsibility
The User remains solely responsible for the content of the User Information they post on the Platform.

13.5 Disclaimer of Responsibility
EldersTalent disclaims any responsibility for harm resulting from downloading or accessing any information or material on the internet through the Platform.

 

14. Indemnity and Limitation of Liability

14.1 Indemnity
You shall indemnify and hold harmless EldersTalent, its owners, licensees, subsidiaries, group companies (as applicable), and their respective officers, directors, agents, and employees from any claims or demands made by third parties, including reasonable attorneys’ fees and penalties. This indemnity applies to claims arising out of your breach of these Terms, the Privacy Policy, or other applicable policies, or your violation of any laws, rules, or regulations, including infringement of intellectual property rights.

14.2 Limitation of Liability
In no event shall EldersTalent, its directors, officers, or any affiliates be liable for any special, punitive, indirect, consequential, or incidental damages, including but not limited to loss of data, business, or other losses (including substitution of services) arising out of or relating to these Terms or any third-party services delivered in connection herewith. This applies even if EldersTalent was previously advised of the possibility of such damages, and regardless of whether the liability arises out of contract, negligence, tort, strict liability, or any other legal theory.

14.3 Exclusions of Liability
The Company will not be liable to you (whether under contract, tort, or otherwise) in connection with:

(a) Any direct loss arising from the services availed from Third-Party Organizations on the Platform;
(b) Any indirect, special, or consequential loss; or
(c) Any business losses, including loss of revenue, income, profits, anticipated savings, contracts or business relationships, reputation or goodwill, or loss or corruption of information or data.

 

15. Intellectual Property Rights

15.1 Ownership of Intellectual Property
The Company owns all trademarks, including but not limited to the brand logo and other service marks, as well as copyright, patents, and all other intellectual property rights related to the Platform, Services, and their content (“Intellectual Property”), excluding User Information. Except as expressly provided, nothing in this Paragraph grants any license or right to the Company’s Intellectual Property. No materials available on the Platform may be used, stored, or transmitted by any means (including electronic, mechanical, scanning, photocopying, or recording) without the prior written permission of the Company. The Company does not represent or warrant that any use of the information on this Platform will not infringe on any third-party Intellectual Property rights.

15.2 Use of Aggregated User Information
Any User Information collected by the Company, which may be used in an aggregated format, is the Company’s property. The Company may use this information, at its sole discretion and without compensation to the User, for any legitimate purpose, including but not limited to commercial sale to third parties.

15.3 Restrictions on Modification and Use
Other than as specified above, neither the Platform nor any of its contents may be modified or copied in whole or in part, including by framing, incorporation into other websites, or other publications, or used to create any derivative work. No links to the Platform may be included in any other website without the Company’s prior written permission.

15.4 No Grant of Rights or License
Nothing on the Platform should be construed as granting any right or license. The Company does not guarantee that you have any right to use content available on the Platform that is owned by Users or any third party, and permission from the third party may be required before using such content. None of the contents may be altered, nor may any copyright or author attribution notices on any of the contents be changed or removed, without the Company’s permission.

 

16.Privacy
Where EldersTalent collects the User’s personal information as a result of the User’s accessing and using the Platform and/or the EldersTalent’s Services, the Privacy Policy will apply to that information. Accordingly, these Terms must be read in conjunction of the Privacy Policy.  
 

17. Confidentiality

17.1 Confidential Information
Both the User and EldersTalent acknowledge that some information exchanged through the Platform and Services may be confidential. Accordingly, any information provided by the User to EldersTalent that is explicitly marked as “CONFIDENTIAL” at the time of transfer shall not be disclosed to any third party and shall not be used for purposes other than those contemplated by these Terms and the Privacy Policy.

17.2 Exclusions from Confidential Information
Confidential Information does not include information that:
(i) is or becomes publicly known without breach of any obligation owed to the disclosing party;
(ii) was known to the receiving party prior to disclosure by the disclosing party without breach of any obligation owed to the disclosing party;
(iii) is received from a third party without breach of any obligation owed to the disclosing party; or
(iv) was independently developed by the receiving party.

17.3 Legal Disclosure
EldersTalent reserves the right to disclose any information, including User Information, when required to do so by applicable law, regulation, legal process, or governmental request. In such cases, EldersTalent will, if permissible, provide notice to the User regarding the disclosure.

 

18.Third-party products and integrations
The Company may through its Platform, provide links to third-party websites. The Company does not make any representations or warranties with respect to such third-party websites. Further, the Company is not responsible for the practices employed by these websites, applications, or services linked to or from the Services or Platform, including the information or content contained there. Such third-party websites are subject to that third party’s own rules, policies, and practices, and not the Company’s Terms.  
 
19.Modifications
The Company may periodically change these Terms to keep pace with new technologies, industry practices, and regulatory requirements, among other reasons.  While, the Company expects most such changes to be minor, the Company requests the Users to periodically review the changes.
 

20. Profanity Policy

20.1 Zero-Tolerance Policy
EldersTalent maintains a zero-tolerance policy towards hateful, offensive, vulgar, rude, inappropriate, threatening, and abusive language or behavior (“Profane Content”). Profane Content is not permitted on the Platform, including in relation to:
(a) Profiles and profile names;
(b) Feedback modules;
(c) Any information or documents uploaded by the User;
(d) Any other part of the Platform accessible by the public or other Users.

20.2 Consequences of Profane Content
In the event of Profane Content, EldersTalent may take the following actions:
(a) Pursue any legal actions available, including criminal actions, against the User based on complaints received; and/or
(b) Remove Profane Content from the Platform, either proactively or in response to complaints; and/or
(c) Suspend or terminate the User’s Account.

22.Grievance Redressal
22.1 Any complaints with regards to use, of Platform may be taken up with the grievance officer appointed by Company (“Grievance Officer”). The details of the Grievance Officer are as follows:

22.2 The Grievance Officer shall acknowledge the complaint within twenty four hours and dispose off such complaint within a period of fifteen days from the date of its receipt.
 
23.Electronic Communications

You consent to receive communications from Us electronically (for example, email or online posting). We may communicate with You by email, and You agree that all agreements, notices, disclosures and other communications that We provide to You electronically satisfy any legal requirement that such communications be in writing.  When You provide Us with an email address for purposes of receiving communications, You confirm that the email address You have given Us is an appropriate vehicle for the delivery of notices and other information to You and We may send notices to You by email, instead of (or in addition to) postal mail.
 
24.Opting Out

21.1 EldersTalent may send periodic promotional or informational emails to Users in accordance with their communications preferences. At any time, Users may opt out of such communications by following the opt-out instructions contained in the email. Please note that it may take up to thirty (30) business days for EldersTalent to process opt-out requests.

21.2 Please note that, even after the User opts out from receiving marketing messages from Us, the User may continue to receive transactional and product-related messages.
